The Longshore and Harbor Workers' Compensation Act (LHWCA) / Defense Base Act (DBA) is designed to help employees who are injured on the navigable waters of the United States (or adjoining waterways). An injury may include an occupational disease. Compensation for a disease includes coverage for a preexisting disease which is worsened as a result of employment.
Who Is Covered?
The LHWCA / DBA applies to workers injured on the navigable waters of the United States and adjoining waterways. It does not cover masters or members of a crew or vessel. Masters and crew members, however, are covered by the Jones Act. We handle Jones Act cases as well. The LHWCA / DBA covers employees who are working on waterways and are injured. Examples of covered workers may include electricians, welders, construction workers and workers performing repairs. Coverage includes service of all ships, boats and most other water-based structures. Even pleasure boats or casinos on water may be covered.

Medical and Financial Benefits
People who receive benefits under the LHWCA / DBA will receive financial compensation to pay for medical bills, lost wages and necessary rehabilitation services. Rehabilitation services may include career counseling services and the cost of school tuition for workers who are not able to return to their job due to a maritime injury. Survivor benefits are available to widows and widowers, as well as certain dependent family members in the event an employee dies as a result of the maritime accident or occupational disease.
